User Data Deletion

This page explains how to ask us to delete the personal information we hold about you, and the rights you have under privacy laws such as the EU/UK General Data Protection Regulation (GDPR) and the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA). It supplements our Privacy Policy, which describes how we collect, use, and share your information.

How to Request Deletion of Your Data

To request deletion of the personal information we hold about you, email us at info@ninjakidzparks.com with the subject line "Data Deletion Request." So we can locate your records, please include your full name, the email address and/or phone number associated with your account or visits, and the Ninja Kidz Park location(s) you have visited. You may also make a request in person at any Ninja Kidz Park.

Verifying Your Identity

To protect your information and prevent unauthorized deletion, we will take reasonable steps to verify your identity before acting on your request, which may include asking you to confirm details we already hold about you. An authorized agent may submit a request on your behalf if they provide proof that you have authorized them to act for you. We will not use the information you provide for identity verification for any purpose other than processing your request.

What Happens After You Submit a Request

We will acknowledge your request and respond within the timeframes required by applicable law. Under the GDPR, we will respond within one month, which may be extended by up to two further months for complex or numerous requests (we will tell you if an extension applies). Under the CCPA/CPRA, we will confirm receipt within 10 business days and respond within 45 days, which may be extended by an additional 45 days where reasonably necessary (we will notify you of any extension).

Once your identity is verified, we will delete the personal information we hold about you that we are not required or permitted by law to retain, and we will direct our service providers and processors to delete it as well. If we cannot fully honor your request, we will explain why.

Information We May Retain

Certain information may be retained after a deletion request where retention is permitted or required by law. For example, we may retain information as necessary to:

  • Comply with our legal, tax, accounting, and recordkeeping obligations, or a legal hold;
  • Complete a transaction or provide a service you requested;
  • Maintain safety records and signed liability waivers relating to park visits and participation;
  • Detect, prevent, or investigate fraud, security incidents, or illegal activity;
  • Exercise or defend legal claims, and otherwise protect our rights and the rights of others.

We will retain only the information reasonably necessary for these purposes and will delete or de-identify it when it is no longer needed.

Your Rights Under the GDPR (EU / UK)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the right to request erasure of your personal data (the "right to be forgotten") under Article 17 of the GDPR, subject to the exceptions above. You also have rights to access, correct, restrict, and object to our processing of your personal data, and to data portability. Where our processing is based on your consent, you may withdraw that consent at any time without affecting the lawfulness of processing carried out before withdrawal. You have the right to lodge a complaint with your local data protection supervisory authority.

Your Rights Under the CCPA / CPRA (California)

If you are a California resident, you have the right to request that we delete personal information we have collected from you, subject to certain exceptions permitted by law. You also have the right to know what personal information we collect, use, and disclose; the right to correct inaccurate personal information; and the right to opt out of the sale or sharing of personal information. We do not sell your personal information. We will not discriminate against you for exercising any of your privacy rights, and you may use an authorized agent to submit a request on your behalf.
